PUBLIC HEARING OF THE PLANNING AND ZONING COMMISSION

SUBJECT: MAYPINE FARM ESTATES
PZ01032-3 VARIANCE TO CUL-DE-SAC LENGTH REQUIREMENTS

Public Hearing was called to order at 8:01 p.m. Notices of this Public Hearing were mailed in accordance with Section 1113.04.

Variance is requested as follows:

1. Variance of 1,900 feet from Section 1167.09(j): "STREET LAYOUTS, Cul-de-sac Streets," which allows a maximum length of 400 feet to the center of the turnaround, to allow the construction of a 2,300 foot long temporary cul-de-sac.

Josh Simon, White Road Development Company, 23360 Chagrin Boulevard #208, Beachwood, Ohio 44122, appeared before the Commission to obtain a variance to cul-de-sac length requirements for the Maypine Farm Estates subdivision.

Chairman Mastrangelo advised the applicant of his right to be represented by an attorney. The applicant waived that right.

Mr. Simon explained that the Maypine Farm Estates subdivision will be constructed in two (2) phases. He said that the subdivision will ultimately contain fifty-four (54) lots. He stated that the proposed variance to the cul-de-sac maximum length requirement is necessary because the main boulevard of the subdivision will not tie into Longspur Road until the second phase of construction. Mr. Simon said that the variance is temporary and will terminate during the second phase when the main boulevard ties into Longspur Road.

Mr. Simon stated that he will comply with the City's requirement and loop the waterline from Miner Road to Longspur Road during the first phase. Chairman Mastrangelo stated that a contingency of the proposed variance will be that the waterline be looped prior to any building permits being issued.

Mr. Simon stated that the waterline will be looped in late December of 2003 or early January of 2004. He said that construction will begin in late March or early April of 2004.

In response to Mrs. Murphy's inquiry as to the number of homes in each phase, Mr. Simon replied thirty-four (34) homes in the first phase and twenty (20) homes in the second phase.

Public Hearing opened to the public.

Terrence Rogers, homeowner, 281 Miner Road, asked for clarification of the proposed variance. Mr. Simon showed the subdivision plans to Mr. Rogers and specifically identified the temporary cul-de-sac and the waterline.

Public Hearing closed at 8:10 p.m.
