REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION

MOTION ON THE MINUTES:  The reading of the Minutes of the regular meeting held June 25, 2007 was dispensed with.  Mr. Pilla moved to accept the Minutes as written; seconded by Mr. Kerr.  Ayes all; motion carried.

 

The reading of the Minutes of the Public Hearing for Brian Himmel held June 25, 2007 was dispensed with.  Mr. Pilla moved to accept the Minutes as written; seconded by Mr. Kerr.  Ayes all; motion carried.

 

SUBJECT:     BRIAN HIMMEL, 416 MEDWAY ROAD

PZ07008          VARIANCES TO SIDE YARD AND GARAGE DEPTH REQUIREMENTS

 

No one was present for this matter.  The Public Hearing was previously held at the regular meeting on June 25, 2007.  At that time the applicant chose to continue the Public Hearing to allow time to revise his plans.  Mr. Pilla is now reporting that the applicant has chosen to withdraw his variance request and may reapply at a later date.  Mr. Pilla agreed to contact the applicant regarding the status of his situation.

 

SUBJECT:     BVQ HOMES INC., 360 GLASGOW DRIVE, S/L 51, ABERDEEN AREA “H”

PZ07011          FINAL HOME APPROVAL

 

Sam Papa, President, BVQ Homes Inc., appeared before the Commission to obtain final home approval for the proposed home to be located at 360 Glasgow Drive, S/L 51, Aberdeen Area “H”.

 

Mr. Papa presented a copy of the site plan for the Commissioners to review.  Sublot 51 is at the corner of East Edinburgh and Glasgow Drives and does not abut the golf course.

 

Chairman Mastrangelo stated that BVQ Homes Inc. is not the original owner of S/L 51 and inquired as to how the applicant procured the lot.  Mr. Papa replied that he purchased the lot directly from Forest City Enterprises.  In response to Chairman Mastrangelo’s inquiry as to whether the applicant had purchased additional lots, Mr. Papa replied no.

 

At the regular meeting held on June 25, 2007, the Commission ruled that site plans for dwellings within the Aberdeen subdivision must include the designation of all areas that could accommodate patios, decks and porches without encroaching into any required setbacks, for the purpose of assuring that builders and homeowners are aware of the setback requirements and to aid the city with enforcement of the rules.  Mr. Knezevic is now inquiring if the designated areas should be marked on the site plans for all lots within the Aberdeen subdivision or for only those lots that abut the golf course.  The Commission agreed that the designated areas should be marked for golf course lots only because there have been no encroachment issues reported on interior lots.

 

Building Commissioner Stouffer reported that the street address for the proposed house on S/L 51 may change and that the City Engineer will make the final determination as to whether the house will have a Glasgow Drive or East Edinburgh Drive address.

 

Mr. Papa presented the required approval signature sheet to Chairman Mastrangelo.

 

MOTION:  A motion was made by Mr. Kerr to grant final home approval to BVQ Homes Inc., on property located at 360 Glasgow Drive, S/L 51, Aberdeen Area “H”; seconded by Mr. Pilla.  Roll call on the motion.  Ayes Kerr, Knezevic, Mastrangelo, Pilla, Urban.  Ayes all; motion carried.

 

Chairman Mastrangelo signed and returned the approval signature sheet to Mr. Papa.

 

SUBJECT:     NICK & JENNIFER MONACHINO, 392 KILBRIDGE DRIVE

PZ07010          DISCUSSION OF PROPOSED DECK

 

Jennifer Monachino, homeowner, 392 Kilbridge Drive, appeared before the Commission to review plans for a proposed deck to be located at the rear of the existing house on property located at 392 Kilbridge Drive.

 

Chairman Mastrangelo stated that the applicant’s house on Kilbridge Drive in the Aberdeen Recreation and Residential (R&R) Development District subdivision abuts the rear lot line of Castlehill Drive.  He said that R&R Section 1124.05 C-3 establishes a rear yard setback of fifty-five feet; however, it does not address the yard requirements for decks.  He said that R&R code states that regular code applies in cases that are not addressed in R&R code, and that regular code establishes a rear yard setback of forty feet for decks.

 

Mrs. Monachino stated that the proposed deck will be sixteen feet from the side property line.  The site plan indicates that the rear yard setback will be greater than the required setback of forty feet and will be in compliance.

 

Mrs. Monachino presented photographs of her property, a site plan, a landscape plan and a drawing of the proposed deck. She said that the proposed hexagon-shaped deck will be constructed off the existing kitchen sliding doors on the southwest corner of the property.  She said that the house is undersized for the lot compared to other homes in the neighborhood, and that the proposed deck will enhance the scale of the property and will not look overpowering.

 

Building Commissioner Stouffer advised the applicant not to encroach into the swales and easements on the property.  Mrs. Monachino replied that her lot was not originally graded properly, and that she will have her lot regraded to correct current water problems.

Mrs. Monachino presented signatures of approval for the proposed deck from the adjacent east and west neighbors.  The Commission agreed that the proposed deck complies with code, and authorized the Building Commissioner to issue a building permit.

 

SUBJECT:     ABERDEEN COMMONS ASSISTED LIVING DEVELOPMENT, 399 BISHOP ROAD

PZ07007          PRELIMINARY SITE PLAN APPROVAL

 

No one from the Aberdeen Commons Assisted Living Development was required to attend this meeting.

 

Chairman Mastrangelo reported that the Commission is in receipt of a letter from the City Engineer dated June 8, 2007 approving the preliminary site plan for the Aberdeen Commons Assisted Living Development, contingent on the applicant providing a parking analysis that demonstrates the adequacy of the proposed parking.  He said that the Commission is in receipt of a memo from the Fire Prevention Bureau dated July 6, 2007 approving the Improvement Plans dated July 2, 2007, contingent on compliance with six comments indicated in the letter.

 

MOTION:  A motion was made by Mr. Pilla to grant preliminary site plan approval for the Aberdeen Commons Assisted Living Development, contingent on issues raised by the Fire Prevention Bureau be addressed prior to final site plan approval; seconded by Mr. Kerr.  Roll call on the motion.  Ayes Kerr, Knezevic, Mastrangelo, Pilla, Urban.  Ayes all; motion carried.

 

SUBJECT:     ALPHA RETAIL SHOPPING PLAZA, ALPHA DRIVE

PZ07012          DISCUSSION OF PROPOSED SHOPPING PLAZA

 

No one was present for this matter.  The Commission is in receipt of a drawing of a proposed site plan for a retail shopping plaza to be located at the northeast corner of Alpha Drive and Wilson Mills Road.

 

Chairman Mastrangelo stated that there may be a prospective buyer for the properties at the northeast corner of Alpha Drive and Wilson Mills Road at the site of the existing Wellington’s restaurant and Syms warehouse and the site of the vacant Sunoco station on Wilson Mills Road.  He said that the applicant may appear at the next regular meeting on July 23, 2007 for a discussion of the proposed project.

 

Building Commissioner Stouffer stated that the project status is very preliminary and that rezoning of the site to local business would need to be addressed.
