REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION

HELD:  AUGUST 28, 2006

 

PRESENT:     Commissioners Kerr, Knezevic, Mastrangelo, Pilla, Urban;

                        Recording Clerk Olson; Building Commissioner Jamieson

 

ABSENT:        None

 

MOTION ON THE MINUTES:  The reading of the Minutes of the regular meeting held July 10, 2006 was dispensed with.  Mr. Kerr moved to accept the Minutes as written; seconded by Mr. Pilla.  Ayes all; motion carried.

 

The reading of the Minutes of the regular meeting held August 14, 2006 was dispensed with.  Mr. Kerr moved to accept the Minutes as written; seconded by Mr. Pilla.  Ayes all; motion carried.

 

SUBJECT:     WALTER BUSHER, 5986 CASTLEHILL DRIVE

PZ06019          VARIANCE TO REAR YARD SETBACK REQUIREMENT

 

Walter Busher, homeowner, 5986 Castlehill Drive, and Ron Shore, Patio Enclosures, Inc., 700 East Highland Road, Macedonia Ohio 44056, appeared before the Commission to obtain one variance to the rear yard setback requirement for a proposed enclosed porch on property located at 5986 Castlehill Drive.  The Public Hearing was held prior to the regular meeting.

 

MOTION:  A motion was made by Mr. Pilla to grant Walter Busher, on property located at 5986 Castlehill Drive, a variance of six feet (6’) from Section 1123.08: “AREA, YARD AND HEIGHT REGULATIONS” from the rear yard setback requirement of fifty-five feet (55’), to permit a rear yard setback of forty-nine feet (49’), for a building length of fourteen feet (14’); seconded by Mr. Kerr.  Roll call on the motion.  Ayes Kerr, Knezevic, Mastrangelo, Pilla, Urban.  Ayes all; motion carried.

 

Chairman Mastrangelo requested that the clerk poll the Commissioners in the majority as to their reasoning for the manner in which they voted.  The consensus of the Commission for approving the variance was that it was a minimal amount; that a practical difficulty exists because the existing unscreened patio cannot be enjoyed due to the large number of bugs; and because there was no opposition from the neighbors.

 

SUBJECT:     DONALD L. BARR & CO., ABERDEEN AREA “J”, PHASES 4 & 5

PZ06018          VARIANCE TO CUL-DE-SAC LENGTH AND LOOK-ALIKE ORDINANCE

 

Donald L. Barr, Donald L. Barr & Co, 8972 Darrow Road, Suite A-205, Twinsburg, Ohio 44087, also, Legends Building Co., 7059 Old Mill Road, Chesterland, Ohio 44026, appeared before the Commission to obtain two variances for The Legends at Aberdeen, Aberdeen Area “J”, Phases 4 and 5.  The Public Hearing was held prior to the regular meeting.

 

MOTION:  A motion was made by Mr. Pilla to grant Donald L. Barr & Co., on property known as Aberdeen Area “J” Phases 4 & 5, a variance of 100 feet from Section 1167.09(j): “STREET LAYOUTS, Cul-de-sac Streets,” which allows a maximum length of 400 feet to the center of the turnaround, to allow a length of 500 feet to the center of the turnaround; seconded by Mr. Urban.  Roll call on the motion.  Ayes Kerr, Knezevic, Mastrangelo, Pilla, Urban.  Ayes all; motion carried.

 

MOTION:  A motion was made by Mr. Pilla to grant Donald L. Barr & Co., on property known as Aberdeen Area “J” Phases 4 & 5, a variance from Section 1111.03: ALook-Alike Homes and/or Housing Groups,@ to permit housing groups to be of similar nature to achieve uniformity of design and architecture, contingent on a material color palette/matrix being presented at time of final site plan approval; seconded by Mr. Urban.  Roll call on the motion.  Ayes Kerr, Knezevic, Mastrangelo, Pilla, Urban.  Ayes all; motion carried.

 

Chairman Mastrangelo requested that the clerk poll the Commissioners in the majority as to their reasoning for the manner in which they voted.  The consensus of the Commission for approving the variance to the cul-de-sac length was that it was a minimal amount; this type of variance has been granted in the past; and that a practical difficulty exists due to the unique location of the street and its access to Miner Road. The consensus of the Commission for approving the variance to the look-alike ordinance was that this type of variance has been granted in the past and it assures the applicant that he can proceed with designing the architectural drawings of the buildings.

 

SUBJECT:     DONALD L. BARR & CO., ABERDEEN AREA “J”, PHASES 4 & 5

PZ06018          PRELIMINARY SITE PLAN APPROVAL

 

Donald L. Barr, Donald L. Barr & Co, 8972 Darrow Road, Suite A-205, Twinsburg, Ohio 44087, also, Legends Building Co., 7059 Old Mill Road, Chesterland, Ohio 44026, appeared before the Commission to obtain preliminary site plan approval for The Legends at Aberdeen, Aberdeen Area “J”, Phases 4 and 5. 

 

Chairman Mastrangelo stated that the following letters of approvals have been obtained:  City Engineer dated 8/22/06; Fire Department dated 6/21/06; Police Department dated 8/17/06; Law Director Paluf dated 8/25/06 regarding the Declaration of Covenants, Easements and Restrictions, the Code of Regulations and the Articles of Incorporation.

 

Mr. Barr stated that the three proposed tri-plexes at the entrance to Phase 4 will adhere to the existing Homeowners’ Association agreement for the condominiums in Phases 1, 2, and 3.  He said that the remainder of buildings to be built in Phases 4 and 5 are fee-simple duplexes with actual lots and will adhere to their own Homeowners’ Association agreement.

 

Mr. Barr stated that Phase 4 construction will begin in March, 2007.

 

MOTION:  A motion was made by Mr. Pilla to grant preliminary site plan approval to Donald L. Barr & Co. for Aberdeen Area “J” Phases 4 & 5; seconded by Mr. Kerr.  Roll call on the motion.  Ayes Kerr, Knezevic, Mastrangelo, Pilla, Urban.  Ayes all; motion carried.
