MOTION ON THE MINUTES: The reading of the Minutes of the regular meeting held May 22, 2006 was dispensed with. Mr. Urban moved to accept the Minutes as written; seconded by Mr. Kerr. Ayes all; motion carried.
The reading of the Minutes of the Public Hearing for John P. Hollis held May 22, 2006 was dispensed with. Mr. Kerr moved to accept the Minutes as written; seconded by Mr. Urban. Ayes all; motion carried.
The reading of the Minutes of the Public Hearing for William Dagg held May 22, 2006 was dispensed with. Mr. Kerr moved to accept the Minutes as written; seconded by Mr. Knezevic. Ayes all; motion carried.
SUBJECT: SALVATORE L. DOTTORE, 665 LANDER ROAD
PZ06014 VARIANCE TO DRIVEWAY REQUIREMENTS
Salvatore L. Dottore, homeowner, 665 Lander Road, appeared before the Commission to obtain a variance for the expansion of the existing 16’ wide driveway on property located at 665 Lander Road. The Public Hearing was held prior to the regular meeting.
MOTION: A motion was made by Mr. Urban to grant Salvatore L. Dottore, on property located at 665 Lander Road, a variance of 6’ from Section 1323.02(d): “Permanent Driveways; Two Car Garages”, which establishes a maximum driveway width of 20’, to allow a driveway width of 26’ for a length of 22’, and then tapering to the existing driveway for a length of 18’; seconded by Mr. Kerr. Roll call on the motion. Ayes Knezevic, Mastrangelo, Urban, Kerr. Ayes all; motion carried.
Chairman Mastrangelo requested that the clerk poll the Commissioners in the majority as to their reasoning for the manner in which they voted. The consensus of the Commission for approving the variance was that the layout of the neighbor’s driveway and the location of the property line precluded a normal turnaround as allowed by code and that the total amount of concrete was not significantly greater than a standard turnaround.
SUBJECT: WILLIAM & NANCY McCRACKEN, 336 MINER ROAD
PZ06017 VARIANCES TO GARAGE REQUIREMENTS
William and Nancy McCracken, homeowners, 336 Miner Road, and Gabe Arnold, Gabe Arnold Construction, 15124 Lake Avenue, Middlefield, Ohio 44062, appeared before the Commission to
review a request for the variances necessary for the construction of a new, attached, three-car garage on property located at 336 Miner Road.
Mrs. McCracken stated that they live in a 2,000 square foot home that is over 100 years old on a one acre parcel. She said that they are proposing to tear down the existing two-car, detached garage and construct a three-car attached garage. She stated that the proposed garage doors will be on a side exposure and will not be visible from the street.
Mrs. McCracken stated that they are requesting a variance of 500’ from the minimum required dwelling area of 2,500 square feet for a three-car garage to allow a three-car garage to be built with a dwelling size of 2,000 square feet.
Mrs. McCracken stated that they are requesting a variance of 3’ to allow a garage depth of 28’. She said that this is necessary to maintain the line of the steep roof of the house. In response to Chairman Mastrangelo’s inquiry if the line of the roof could be maintained with a garage depth of 25’ that is allowed by code, Mr. Arnold replied yes. Mr. McCracken replied that he is requesting the extra depth in order to store a jet ski and 17’ boat. In response to Chairman Mastrangelo’s inquiry if a garage depth of 25’ would accommodate the boat and jet ski, Mr. McCracken replied no.
Mrs. McCracken stated that they are requesting a variance in height to allow a two-story garage which is necessary in order for the garage roofline to be similar in style and appearance to the house. She said that there will be a permanent flight of stairs leading to a full second story in the garage that will have a ceiling high enough for standing room. She stated that the second story of the garage will not be habitable space, but will be used for storage only. She said that the existing garage has a permanent flight of stairs leading to a second story that is used for storage.
Mr. Arnold stated that the new garage will be 2’ to 3’ higher than the existing garage but will be lower than the house. Mrs. McCracken said that the adjacent house to the south of her property is quite tall and that the height of her proposed garage will not look out of place.
Mrs. McCracken stated that the distance from the proposed garage to her side property line will be 34’. She said that the distance from the neighbor’s house to the same property line is 10’; therefore, the distance from the proposed garage to the adjacent house will be 44’.
Discussion ensued as to whether a height variance is required for a two-story attached garage because code does not stipulate a height restriction for an attached garage. The Commission referenced Section 1123.08 and agreed that an attached garage is considered as part of the main building and, therefore, allowed to be a maximum of 2-1/2 stories in height. The Commission agreed that a variance in height for the proposed garage is not required.
The issue of whether the second floor of the proposed garage should be considered as additional square footage or simply secondary storage was discussed. The Commission agreed that the second story will be considered as secondary storage.
Chairman Mastrangelo and Mr. Knezevic advised the applicant to submit a floor plan showing the layout of the applicants’ belongings in the proposed garage.
Chairman Mastrangelo advised that a Public Hearing will be held on June 26, 2006.
SUBJECT: PHILIPS MEDICAL SYSTEMS, 595 MINER ROAD
PZ06015 REVIEW OF PROPOSED BUILDING ADDITION
Carl Bell, Structura Architects, 2251 Front Street, Suite 109, Cuyahoga Falls, Ohio 44221, representing Philips Medical Systems, 595 Miner Road, appeared before the Commission to obtain final site plan approval for the proposed 7,000 square foot building addition to connect building #1 and building #2 on property located at 595 Miner Road.
Building Commissioner Jamieson stated that all of the required approvals have been satisfied.
MOTION: A motion was made by Mr. Knezevic to grant final site plan approval to Philips Medical Systems, on property located at 595 Miner Road, for the proposed 7,000 square foot building addition to connect buildings #1 and #2; seconded by Mr. Kerr. Roll call on the motion. Ayes Knezevic, Mastrangelo, Urban, Kerr. Ayes all; motion carried.
ADJOURNMENT: A motion to adjourn the meeting was made by Mr. Urban and seconded by Mr. Knezevic. Said meeting adjourned at 9:00 p.m.
