CITY OF HIGHLAND HEIGHTS

MINUTES OF A SPECIAL COUNCIL MEETING

HELD:  AUGUST 26, 2008

5:30 P.M.

President of Council Mills presiding.

PRESENT:      Mayor Coleman, Councilmen Anderson, Lombardo, Mills, Murphy, Pilla; Clerk of Council Buchak; Law Director Paluf.

ABSENT:         Councilmen Hargate, Legan, excused.

This special meeting has been called for consideration of the following:

            Motion appointing legal counsel to represent the City of Highland Heights in the case Bass Energy Incorporated v. City of Highland Heights.

ADOPTION OF RESOLUTION 47-2008:  Council listened to the First Reading in title only of Proposed Resolution 47-2008 which description is:  "A Resolution retaining John P. O'Neil and Reminger Co., L.P.A. to provide legal services to the City of Highland Heights in all matters arising from the pending litigation with Bass Energy, Inc. and declaring an emergency.  Mr. Lombardo moved to suspend the Second and Third Reading; seconded by Mr. Pilla.  Ayes all; motion carried.  Mr. Pilla moved to adopt; seconded by Mr. Anderson.  Ayes all; motion carried.

ADJOURNMENT:   A motion was made by Mr. Pilla and seconded by Mr. Anderson to adjourn the meeting.  Said meeting adjourned at 5:36 p.m.
